1. Acceptance
This Juele User Agreement (the “Agreement”) is between you and the operator of the Juele app (“Juele,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the Juele mobile application and related in‑app content (the “App”), you agree to this Agreement. If you do not agree, do not use the App.
This Agreement is intended as an end‑user user agreement for an app that primarily runs on your device. Separate documents (such as a Privacy Policy) describe how personal data is handled.
2. Who May Use Juele
- Age. You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the consent of a parent or legal guardian who is responsible for your use.
- Authority. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to this Agreement.
- Compliance. You will comply with applicable laws and with Apple’s App Store terms and platform rules that apply to your device.
3. License & App Use
Subject to your compliance with this Agreement, we grant you a personal, non‑exclusive, non‑transferable, revocable, limited license to download and use the App for your personal, non‑commercial use on Apple‑branded products that you own or control, as permitted by the App Store’s Usage Rules.
- No resale. You may not rent, lease, sell, sublicense, or otherwise commercially exploit the App.
- No reverse engineering. You may not decompile, reverse engineer, disassemble, or attempt to derive source code from the App except to the extent permitted by law.
- Updates. The App may update automatically. Some updates may change or remove features.
4. Photos & Permissions
The App may request permission to access your device’s photo library so you can import and experience your photos within the App. You can control or revoke photo permissions at any time in your device settings.
Your device and Apple frameworks (including PhotoKit) determine what photo access is available (e.g., “selected photos” access). The App’s functionality may be limited if you decline or later revoke permissions.
5. Your Content
“User Content” means photos, videos, metadata, tags, captions, and other content you import into or generate within the App. You represent that you have all rights necessary to use your User Content with the App.
- Ownership. You retain ownership of your User Content.
- License to operate the App. You grant us a limited license to process your User Content solely as necessary to provide App functionality (for example, rendering immersive scenes, generating thumbnails, or applying effects). This license is non‑exclusive, worldwide, and ends when the content is no longer processed for App functionality.
- No public posting by default. The App is not intended to publish your private photos publicly. If a future feature lets you export/share, you control whether to share and where.
6. Prohibited Conduct
- Use the App in any manner that violates laws or infringes others’ rights (including privacy, publicity, copyright, or trademark rights).
- Attempt to bypass security, access non‑public areas, scrape, or interfere with App operation.
- Use the App to create or distribute malware, exploit code, or harmful content.
- Use the App in a way that could damage, disable, overburden, or impair the App or other users’ devices.
7. Third‑Party Services and Platform Terms
The App may rely on third‑party services and device/platform capabilities (for example, Apple iOS, PhotoKit, StoreKit, device settings, and system permissions). Your use of those third‑party services is governed by their own terms and policies.
8. Disclaimers
The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.
We do not guarantee that the App will be uninterrupted, error‑free, or compatible with all devices. Visual effects, motion, and immersive scenes may cause discomfort for some users; please use the App responsibly and adjust settings to reduce motion or effects if needed.
9. Limitation of Liability
To the fullest extent permitted by law, Juele and its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of (or inability to access or use) the App; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your transmissions or content.
In jurisdictions that do not allow the exclusion or limitation of liability for certain damages, our liability will be limited to the maximum extent permitted by law.
10. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App if you materially breach this Agreement or if required by law. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.
11. Governing Law; Dispute Resolution Notice
This Agreement is governed by the laws of the State of California, United States, without regard to conflict‑of‑laws rules, except where your local consumer protection laws require otherwise.
Where legally permitted, disputes will be resolved on an individual basis and not as a class action. If arbitration is required or elected, it will be conducted in Santa Clara County, California (or remotely), unless applicable law provides otherwise. If you are a California resident, additional rights may apply.
12. Changes to This Agreement
We may update this Agreement from time to time. If we make material changes, we will provide notice within the App or by other reasonable means. Continued use of the App after the effective date of an updated Agreement means you accept the updated Agreement.
